General Terms and Conditions of Use

These General Terms and Conditions of Use (hereinafter referred to as the "T&Cs") are intended to govern the terms and conditions of use of the site accessible at /2025/ (hereinafter referred to as the "Website") published by EQUIP’AUTO (hereinafter referred to as the "Company").
 
A User (they, them) is any person browsing the Website.
 
1. Acceptance and modification of the T&Cs
Use of the Website is subject to compliance with these T&Cs. All Users acknowledge that they accept the T&Cs, without reservation, by the mere fact of using the Website.
The T&Cs may be amended by the Company at any time to take account of changes to the Website and changes to the applicable regulations. The new version of the T&Cs will be made available on the Website.
 
The User is invited to consult them regularly.

The photos illustrating the Website are non-contractual.

3. Website content
The information provided on the Website is presented for general guidance only. It does not claim to be exhaustive.
Despite all the care and rigour taken in the creation of the Website and its regular updating, errors may have crept into the information presented. The Company undertakes to correct them as quickly as possible, but the User must carry out all necessary checks and is solely responsible for the use they make of the information available.

5. Intellectual property rights
5.1. The Website and each of its components, including but not limited to texts, trademarks, logos, sounds, music, layouts, media, icons and, more generally, all visual or sound elements (hereinafter referred to as the "Intellectual Property Items"), are protected by intellectual property rights held by the Company or licensed to the Company by one or more third parties.
Some of the intellectual property items may also be the property of third parties who have granted the Company a right of use.
Apart from the cases authorised by law, any reproduction, representation, modification, distribution, adaptation, translation and/or total or partial transformation, integration with other items or transfer to another website of all or part of the intellectual property items without the prior express written authorisation of the Company or the third parties concerned who hold the intellectual property rights is strictly prohibited.

6.1.  No hyperlink may be inserted on the Website for any reason whatsoever.
Links to a Website containing information of an illicit, violent, controversial, pornographic or xenophobic nature and/or infringing the intellectual property rights of a third party and/or damaging the Company's image and/or reputation are prohibited.
6.2. Any hyperlink to this Website is prohibited without the Company's prior written authorisation. The Company may withdraw this authorisation at any time and remove the link if it does not comply with applicable legislation or if the link does not comply with these T&Cs and other Company policies.
6.3. The Website may contain hyperlinks redirecting the User to third-party websites that are not published by the Company. The Company has no control over these sites and may under no circumstances be held liable for the content published on third-party sites or for any damage or loss arising from browsing these sites.

7. Conditions of access
Except in cases of force majeure, events beyond its control (disruptions or interruptions to access networks, failure of the user's computer or telephone equipment and, more generally, any event linked to Internet access conditions) and subject to any breakdowns and maintenance work necessary for the Website to function properly, the Company undertakes to make its best efforts to ensure that the Website is continuously accessible. The unavailability of the Website, whatever the cause, does not entitle the User to compensation.

8. Undertakings of the User
8.1. The User undertakes to use the Website in accordance with these T&Cs.
8.2. The User acknowledges that they have the skills and resources required to access and use the Website, and acknowledges that they have checked that the computer configuration used does not contain any viruses and is in perfect working order.
The User acknowledges that they have taken all necessary measures to protect their computer system against contamination by potential viruses and against any attempt at intrusion by third parties.
8.3. The User is liable for any loss or damage, whether material or immaterial, resulting from the use of the Website.
8.4. The User shall make use of the information available on the Website under their sole responsibility. If necessary, they must carry out the necessary checks.
8.5. The User undertakes not to infringe the rights of third parties or the image of the Company.
In this respect, the User undertakes not to share any content or hyperlink including, but not limited to:
  • content that is pornographic, paedophilic, violent, obscene or seriously offensive to human dignity;
  • content that infringes the property rights of third parties and/or the Company;
  • content that could be qualified as or constitute incitement to : the commission of crimes or offences, discrimination, hatred or violence, in particular on the grounds of race, ethnic group or nation, glorification of Nazism, denial of the existence of crimes against humanity, undermining the authority of justice, defamation, insult, disparagement, invasion of privacy, or acts endangering minors, content intended to display prohibited objects or works, messages of a defamatory, rude, abusive, violent nature or contrary to the laws in force, messages on tobacco and alcohol, content containing personal details and information allowing precise geographical location (telephone number, address, etc.), messages inciting the consumption of prohibited substances or suicide, messages enabling third parties to obtain, directly or indirectly, pirated software, software serial numbers, software enabling acts of piracy and intrusion into computer and telecommunications systems, viruses and other logic bombs and, in general, any tool or software, messages making it possible to infringe the rights of others and the security of persons and property in violation of the private nature of correspondence, this list being non-exhaustive;
  • a negative or discriminatory connotation (for example, a pseudonym: anti-"X"), a political, religious, fascist, xenophobic, racist, sectarian or similar character, insults, threats or advertising.
8.6. The User undertakes to respect the integrity of the Website. They shall refrain from hindering or forcing the operation of the Website, from fraudulently modifying, altering or deleting the content accessible via the Website and from fraudulently introducing data onto the Website.

9. Liability
The Company may not be held liable for any damage resulting from an interruption, malfunction of any kind whatsoever, suspension or termination of the Website, for any reason whatsoever, or for any material or immaterial damage resulting in any way from connection to the Website. Users connect to the Website at their own risk.

10. Cookies
Users are informed that, when they visit the Website, a cookie may be automatically installed on their browser.

12. Miscellaneous
If any one of the clauses is declared null and void, it will be deemed unwritten, but this will not invalidate the other clauses of these T&Cs.
Failure by the Company to exercise any of its rights under these T&Cs shall not constitute a waiver of its rights.
 
13. Applicable law and jurisdiction
13.1. These T&Cs are governed by French law.
13.2 All disputes arising from the application of these T&Cs, and which cannot be resolved by amicable settlement shall be submitted, notwithstanding multiple defendants and/or third parties, even for emergency proceedings or protective proceedings in summary proceedings or by petition :
  • for disputes with one or more private individuals, to the jurisdiction of the competent French courts;
  • for disputes between professionals, to the exclusive jurisdiction of the courts of the jurisdiction in which the Company has its registered office.
